By accessing or using impactdigitalradio.com, the Impact Digital Radio app, our DAB/DAB+ broadcast, or purchasing merchandise from our shop, you agree to be bound by these Terms and Conditions and our Privacy Policy. These terms are governed by Scots Law and subject to the exclusive jurisdiction of the Scottish courts.

By using this website you confirm that you are at least 18 years of age, or are accessing the site under the supervision of a parent or guardian. You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the site.

• Impact Digital Radio app on Google Play — our official Android app available to download from the Google Play Store, which streams our live radio content and provides access to station features
• DAB and DAB+ digital radio — our licensed digital radio broadcast available on compatible DAB and DAB+ receivers across our coverage area
• Third-party stream directories — our stream may also be accessible via third-party radio directory apps and platforms

Access to our stream and app is provided free of charge on an "as is" and "as available" basis.

• We do not guarantee that any platform will be uninterrupted, error-free, or available at all times
• We reserve the right to alter, suspend, or discontinue any aspect of our service across any platform at any time without notice
• Stream content, show schedules, and presenters may change without prior notice
• You may not record, rebroadcast, redistribute, or otherwise exploit our content from any platform without our prior written consent
• DAB and DAB+ broadcast coverage is subject to signal availability in your area and is outside our direct control once transmitted

Impact Digital Radio operates in full compliance with all applicable UK broadcasting regulations and holds the licences required to broadcast and to perform music publicly. We are committed to maintaining these standards across all our platforms.

Music Performance Licences

• PRS for Music — We hold a valid PRS licence covering the public performance and broadcasting of musical compositions and lyrics on our stream and DAB broadcasts
• PPL (Phonographic Performance Limited) — We hold a valid PPL licence covering the public performance and broadcasting of recorded music (master recordings) across all our services

These licences ensure that songwriters, composers, artists, and record labels are fairly compensated whenever their music is played on Impact Digital Radio. Listeners can be assured that all music broadcast on our station is played legally and ethically.

Any complaints regarding our broadcast content and compliance with the Ofcom Broadcasting Code may be directed to Ofcom at www.ofcom.org.uk.

Impact Digital Radio uses artificial intelligence technology to generate some or all presenter announcements, show introductions, and station content. By using our service you acknowledge and accept the following:

• Some or all on-air presenter voices and content may be AI-generated and do not represent real individuals
• AI presenter characters are fictional and created solely for entertainment purposes
• No AI-generated content constitutes professional advice of any kind
• We reserve the right to modify, replace, or remove AI presenter characters at any time

We take care to ensure AI content complies with broadcasting standards, but we cannot guarantee that all AI-generated material will be entirely free from error or inaccuracy.

Our online shop sells Impact Digital Radio branded merchandise. By placing an order you confirm that you are legally capable of entering into binding contracts and are at least 18 years of age.

• All orders are subject to availability and confirmation of the order price
• We reserve the right to refuse or cancel any order at our discretion
• Prices are displayed in GBP (£) and are inclusive of VAT where applicable
• We reserve the right to change prices at any time without notice, but changes will not affect orders already confirmed
• A contract between you and us is only formed when we send you an order confirmation email

Payment must be made in full at the time of ordering. We accept payment via the methods displayed at checkout. All transactions are processed securely. We do not store payment card details on our servers.

In the event of a pricing error on our website, we reserve the right to cancel the order and issue a full refund, notifying you as soon as reasonably practicable.

Delivery times and costs are displayed at checkout and vary depending on your location and the delivery method selected. We aim to dispatch orders promptly but cannot guarantee specific delivery dates.

• Risk in the goods passes to you on delivery
• We are not responsible for delays caused by third-party couriers or circumstances beyond our control
• If your order is lost or damaged in transit, please contact us as soon as possible

Our returns and refunds process is governed by our separate Refunds & Returns Policy, which forms part of these Terms and Conditions. Please read that document in full before making a purchase.

In addition to our policy, you may also have statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Nothing in these terms affects your statutory rights.

All content on this website and within our radio stream — including but not limited to the Impact Digital Radio name, logo, presenter characters, AI-generated audio, graphics, and text — is the property of Impact Digital Radio / BS Net Trading and is protected by applicable intellectual property laws.

• You may not use our branding, logos, or presenter characters for any commercial purpose
• Unauthorised recording or redistribution of our stream or content is strictly prohibited

Where our services integrate with third-party platforms such as Google Play, streaming infrastructure providers, or social media platforms, those platforms' own terms and conditions will also apply.

To the fullest extent permitted by Scots Law, Impact Digital Radio / BS Net Trading shall not be liable for any indirect, incidental, special, or consequential loss or damage arising out of your use of this website, our stream, or any merchandise purchased from us.
